1.8. Product return

•   1.8.1. The Malagoli Customer may return products purchased through a contract, in the following situations:

 - 1.8.1.1. The packages show severe damage;

  - 1.8.1.2. The products were shipped / invoiced wrong;

  - 1.8.1.3. The products have defects;

  - 1.8.1.4 The products do not correspond to those ordered by the Customer;

  - 1.8.1.5. "The Consumer has the right to notify in writing to waive the purchase, without penalties and without giving any reason, within 14 calendar days since receiving the product." Also, in accordance with art. 7 paragraph. 1 of Government Ordinance 130/2000, the Customer has the right to solely cancel the distance contract, within 14 calendar days since receipt of product / products without penalties and without giving any reason. In this case, the direct cost of returning the goods will fall, according to the law, to the Customer.

•    1.8.2. The Customer undertakes to notify Malagoli, of the intention to return products purchased by any means of written communication (e-mail / fax / etc) within a maximum of 14 calendar days from receipt of the products and / or services.

• 1.8.3. The Customer who notified Malagoli,  under Article 1.8.2, has the responsibility to ensure that the products refered to will be returned within 14 calendar days, otherwise, Malagoli will consider the application unfounded / invalid and can refuse the return.

•    1.8.4. The Malagoli Customer can not return the products purchased and / or can not claim any damages / compensation, in the following situations:

- 1.8.4.1. If the request to return for any of the situations provided in art. 1.8.1 has the date of dispatch of the notification of the intention to return that exceeds the 14 days stipulated under article 1.8.2, calculated from the day following the contract honored.

- 1.8.4.2. If a product is returned motivating one of the situations stipulated in art. 1.8.1, and the product returned is not in the same condition as it was delivered (in original packaging with all the accompanying documents intact).
  - 1.8.4.3. If a product that was part of a kit is returned. Products that are a kit must be returned as a kit.

•1.8.5. In case of product value refund, the refund will be carried out within 14 calendar days since the confirmation of the return.

• 1.8.6. If the Customer who returned the product in accordance with provisions of article 1.8.1.3 and Malagoli does not have a suitable product for replacement, it will provide the customer the value of the product in accordance with 1.8.5.

•1.8.7. The value of additional services including, but not limited to shippment, paid by the customer, will not be refunded.
• 1.8.8. In all cases, the cost of return / re-delivery shall be borne by the customer except the situations set out in paragraphs 1.8.1.1; 1.8.1.2; 1.8.1.3 and if lacking conformity according to 1.8.1., in which Malagoli will bear the shippment fees. Also, in case of a delivery / of item (s) not-ordered, as stipulated in 1.3., the return costs are borne by Malagoli.
