REGULATION

1. THE ORGANIZER

This loyalty program is organized and carried out by SC Malagoli S.R.L. with headquarters in Oradea, 9 Trotusului, Bihor, registered with the Trade Register under Bihor Tribunal. J05 / 1028/2007 with Tax Identification Number 21592347.
The participants in the program are required to comply with the terms and conditions of the General Regulations. The General Regulation is available to any participant in the program for consultation on malagoli.ro site.

2. DATA PROTECTION

According to Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, amended and supplemented, and Law. 506/2004 concerning the processing of personal data and protection of privacy in the electronic communications sector, SC Malagoli S.R.L. is required to manage safely and only for specified purposes your personal data, the purpose to collect data being: to conduct advertising, marketing, advertising activities, offers and Malagoli loyalty card issuing.
The participant is required to provide us with data (such as name, address, e-mail, phone numbers), which are necessary: to identify the participant in order to establish the contractual relationship between him and SC Malagoli S.R.L. in order to enter the loyalty program for sending offers and advertisements from SC Malagoli S.R.L. or counterparties. His refusal makes it impossible to create a tender as mentioned and therefore the participation in Malagoli loyalty program will not be possible.

The information is recorded for use by the operator and is communicated only to counterparts in Romania and other EU countries, for the purposes mentioned in this Regulation. According to Law no. 677/200, the participant shall have the right to access, modify the data, the right not to be subject to individual decisions. He is entitled to oppose the processing of personal data concerning him and request deletion. To exercise these rights, you can submit a written request, dated and signed, at the headquarters of the organizer. In this case the participant will lose their participation to Malagoli loyalty program and can no longer benefit from the program. He also has the right to go to court.

The agreement means the definite expression and the unequivocal consent of the organizer to store, use and process for marketing purposes, advertising and publicity, the information provided during the execution of the program and both parties consider the conditions and provisions set out in these Rules as binding for them.
The General Regulations is available to any participant in the program for consultation on malagoli.ro website. The organizer reserves the right to modify or change the General Regulations, any modifications being effective only after the notice of presentation of changes in public. No modification or suspension does not give the right to a member to allowances and no member can make any kind of appeal against SC Malagoli S.R.L.

3. TERRITORIALITY

MALAGOLI Card loyalty program presented in this Regulation shall be conducted throughout Romania, EU member countries and beyond.

4. DURATION OF PROGRAM

MALAGOLI Card Program has indefinite duration. The organizer has the right to decide at any time the termination or modification of the program. The notification relating to cessation of the program will be displayed on malagoli.ro at least 15 days before the termination date of the program. MALAGOLI Card Program will be held in accordance with the provisions of these General Regulations.

5. REGISTRATION TO THE PROGRAM

Any person who turned 18 years old can be a member of Malagoli loyalty program. The program can be attended only by completing and signing the registration form. The application form is available online on malagoli.ro. The participant is required to fully complete the registration form with real data.

The participant is also obliged to fill in the fields marked as required in the registration form. These fields are: name, surnname, address, zip code, date of birth, phone, e-mail address. The form containing incomplete or erroneous data is not valid. The correct filling of the form, the Malagoli loyalty card activates automatically, with access to the use of accumulated points.

6. MALAGOLI LOYALTY CARD

MALAGOLI Loyalty Card is free and gives its holder the possibility of accumulating points, points that can then be used to purchase an item.
MALAGOLI Loyalty Card has five options:

- Standard

- Silver

- Gold

-Platinum

- VIP

Each participant is entitled to one loyalty card from those listed. Forgery is punishable under the laws. The participant can not request directly the versions Silver, Gold, Platinum or VIP card. The qualification from one level to another is conditioned by the accumulation of points. In addition to these card versions, Malagoli may issue other types of cards, addressed to certain categories of customers, based on separate regulations.

Malagoli loyalty points regardless of the type of card (Standard, Silver, Gold, Platinum or VIP) can not be correlated with other actions:
- discount can not apply to items using the points found in other promotions
- can not transfer points from one card to another
- accumulation of loyalty points without buying or paying a product is illegal
- the points accumulated by a loyalty cardholder, not used in the current year, expires
- the forgery of any type of card is punishable by law

7.   STANDARD, SILVER, GOLD, PLATINUM AND VIP SPECIAL PROGRAMS 

7.1 STANDARD CARD

The loyalty program is based on MALAGOLI Standard loyalty card.

The Standard card version is a program that allows the cardholder to benefit from:     

  • 10% discount on the first acquisition of minimum 200 RON upon the request of MALAGOLI Loyalty Card
  • 100 bonus points in the account as a welcome gift
  • ​​ Every year, in the month that celebrates its cardholder birthday, the latter receives a gift from MALAGOLI consisting in 100 bonus points
  • ​MALAGOLI points doubled in certain periods
  • Access to various special promotions, campaigns, presentations organized and reserved only to MALAGOLI Loyalty Card holders

7.2 SILVER CARD

The Silver Card can be obtained only by Standard Card holders if they accumulate 500 points during a calendar year.

Card holders have:

  • 100 RON worth voucher
  • 100 bonus points as promotion prize
  • 5% discount on every purchase in the current year
  • ​Every year, in the month that celebrates its cardholder birthday, the latter receives a gift from MALAGOLI consisting in 100 bonus points
  • ​MALAGOLI points doubled in certain periods
  • Access to various special promotions, campaigns, presentations organized and reserved only to MALAGOLI Loyalty Card holders 
  • ​Surprise reward

After receiving the Silver card, the cardholder can qualify for the Gold card if he meets the conditions described below in the section for Gold card.
The Silver card holder status is kept for an indefinite period.

7.3 GOLD CARD

The Gold Card can be obtained only by Silver card holders if they accumulate 1000 points during a calendar year.

  Card holders have:

  •  200 RON worth voucher
  • 150 bonus points as a promotion prize
  • 10% discount on every purchase in the current year
  • ​Every year, in the month that celebrates its cardholder birthday, the latter receives a gift from MALAGOLI consisting in 100 bonus points
  • ​MALAGOLI points doubled in certain periods
  • ​Access to various special promotions, campaigns, presentations organized and reserved only to MALAGOLI Loyalty Card holders 
  • ​Surprise reward

After receiving the Gold card, the cardholder can qualify for the Platinum card if he meets the conditions described below in the section for Platinum card.
The Gold card holder status is kept for an indefinite period.

7.4 PLATINUM CARD

The Platinum Card can be obtained only by Gold card holders if they accumulate 2000 points during a calendar year.

  Card holders have:

  • 400 RON worth voucher
  • 200 bonus points as a promotion prize
  • 15% discount on every purchase in the current year
  • ​Every year, in the month that celebrates its cardholder birthday, the latter receives a gift from MALAGOLI consisting in 100 bonus points
  • MALAGOLI points doubled in certain periods
  • ​Access to various special promotions, campaigns, presentations organized and reserved only to MALAGOLI Loyalty Card holders
  • ​ Surprise reward

After receiving the Platinum card, the cardholder can qualify for the VIP card if he meets the conditions described below in the section for VIP card.
The Platinum card holder status is kept for an indefinite period.


 7.5 VIP CARD

 The VIP Card can be obtained only by Platinum card holders if they accumulate 5000 points during a calendar year.

  Card holders have:

  • 1000 RON worth voucher
  • ​ 20% discount on every purchase in the current year 
  • ​ Every year, in the month that celebrates its cardholder birthday, the latter receives a gift from MALAGOLI consisting in 100 bonus points
  • MALAGOLI points doubled in certain periods
  • ​Access to various special promotions, campaigns, presentations organized and reserved only to MALAGOLI Loyalty Card holders
  • ​Holiday for 2 people, a weekend in Milan, Italy.
  • ​Surprise reward

The VIP card holder status is kept for an indefinite period.

 8. CHECKING THE NUMBER OF POINTS

To check the number of points available in the holder’s account, the latter will need to access the special section dedicated to check points on malagoli.ro; he will have to enter the number of the loyalty card and to click on apply, then he will be shown the amount of points until that date.
 

9. RETURNS

- if the participant returns the goods purchased for which he accumulated loyalty card points, the Organizer cancels the number of points allocated prior to the purchase of goods returned

- if the participant returns the goods purchased based on a percentage or value discount coupon, the loyalty program offered in the Malagoli loyalty program, the value of the coupon is not refundable and the discount coupon shall not be given back to the Paricipant.
 

10. UNUSED, DAMAGED, LOST OR STOLEN CARDS

Malagoli reserves the right to cancel any loyalty card after 12 months of non-use or it has been used breaching any of the provisions hereof or of legal provisions. The cards, once canceled, will not be reactivated. The loyalty card holder will also lose the right to benefit from the accumulated points on the canceled card and any other benefits attached to that loyalty card, but he can apply for a new loyalty card by filling in a new application form.

If a loyalty card has been lost, stolen or damaged, the Participant may require the card replacement by written notice to the malagoli.ro. The Participant assumes any misuse of lost card including the use of points earned up to that point. Together with the notification the Participant shall indicate the name, address and other identifying data of the cardholder. The Participant who loses the card or the card is stolen, he is entitled to a new card. During the card replacement the accumulation of points or their use to pay for other products are not possible.
If the case of damaged, lost or stolen cards, the existing points are transferred to the new card. A new card is issued within 30 days from the announcement of loss or theft.
 

11. DEACTIVATING THE MALAGOLI LOYALTY CARD

Deactivating a loyalty card is possible in the following situations:

- at the express request of the card holder to deactivate it by a valid, signed, dated request sent to the organizer to the e-mail address: suportclienti@malagoli.ro
- at the express request of the holder to remove personal data from the database of the organizer or not to process personal data
- if the participant does not purchase any product or service on a consecutive period of 12 months. The participant will lose all the points accumulated in their account and any other benefit attached to the quality of Malagoli loyalty card holder, respectively.
- in case of fraud, attempted fraud or misuse of the loyalty program.
 

12. LITIGATIONS

Any disputes arising between the organizer and the participants to this Loyalty Program will be solved amicably or, if not possible, the disputes will be settled by the competent courts besides the headquarters of the organizer.
